Terms of Service

Preamble

This Terms of Service Agreement (“Agreement”) is a binding contract between you (“User”) and ploros.com (“we,” “us,” or “our”) concerning your access to and use of our web-based platform and associated services (“Service”).

By registering for or using the Service, you confirm that you have read, understood, and agree to be bound by the terms set forth herein. If you do not agree, you may not access or use the Service.

1. Definitions

1.1 Service refers to The platform available at ploros.com, enabling users to create travel blogs, upload photos, share stories, and use related features.

1.2 User refers to Any natural person or legal entity who accesses or uses the Service.

1.3 User Content refers to Any blogs, photos, stories, or other data uploaded by the User.

1.4 Generated Content refers to Any content created or facilitated by the User, including content generated with the assistance of AI tools made available through the Service.

2. Use of the Service

2.1 Service features

The Service enables Users to:

  • Create an account and profile
  • Create, edit, and publish travel blogs
  • Upload and manage photos and stories
  • Share content with others
  • Engage with others

2.2 We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, without liability.

2.3 The Service may be in beta or development stages and could be unstable or interrupted. Use is at your own risk.

2.4 Engagement Features

The Service allows Users to like, comment on, share, and follow blogs and profiles. By using these features, you agree that your interactions (e.g., likes, comments, and follows) may be visible to other users and used pseudonymously for analytics and content recommendation purposes as described in our Privacy Policy.

3. Account and Access

3.1 Registration is required via Google Sign-In or similar, managed by a third-party identity provider. We store only a non-personally identifying user ID and profile details you provide.

3.2 You are solely responsible for your account credentials and for all activity under your account.

3.3 You may request deletion of your account at any time. Any unused Credits will be forfeited without refund.

4. User Content and Rights

4.1 You represent that you own, or have sufficient rights to use, all content you upload. You are solely responsible for its legality, accuracy, and suitability. We do not assume any liability for information or content disclosed in your blogs or shared materials.

4.2 You grant us a limited, non-exclusive, revocable license to process your User Content solely to deliver the Service (e.g., hosting, displaying, and sharing blogs or photos). This license ends upon deletion of the content or your account.

4.3 We may remove content or suspend access if we believe a violation of this Agreement has occurred, or if content is illegal, harmful, or infringing.

5. Generated Content

5.1 If the Service includes any automated features (e.g., content suggestions), Generated Content is provided “as is.” We make no warranties regarding its accuracy or legal usability.

5.2 You may use Generated Content only if you have the legal rights to the original User Content. We disclaim liability for any third-party claims related to your use of Generated Content.

6. Third-Party Services

The Service depends on third-party providers (e.g., for authentication, hosting, or payment processing). We are not liable for service disruptions caused by such providers. For details on data processing and subprocessors, refer to our Privacy Policy.

7. Prohibited Conduct

You agree not to:

  • Upload illegal, infringing, offensive, or harmful content, including false information in blogs
  • Use bots, scripts, or scraping tools
  • Interfere with Service performance or security
  • Reverse-engineer or bypass technical safeguards
  • Violate any applicable law using the Service

Breach of this section may result in account suspension or termination without notice.

8. Full Responsibility for User Content and Blog Posts

You alone are fully responsible and liable for all content you create, upload, publish, or share on the Service—especially all text, photos, recommendations, routes, tips, or other information in your travel blogs.

This includes, but is not limited to:

  • Accuracy, truthfulness, and legality of everything you write or publish
  • Any advice, instructions, or recommendations (e.g., hiking routes, border crossing tips, health or safety advice, and political statements)
  • Any third-party claims arising from copyright, personality rights, defamation, or other violations
  • Any damage, injury, financial loss, or other harm that other users or third parties suffer as a result of relying on or following your blog content

We do not review, moderate, or endorse user blogs. We are a neutral hosting platform and assume no responsibility whatsoever for user-generated content.

9. Limitation of Liability and Disclaimer for User-Generated Content

9.1 To the fullest extent permitted by applicable law, we shall not be liable for any user-generated content, including but not limited to any blogs, posts, photos, comments, recommendations, or information published by Users on the Service.

9.2 We explicitly disclaim any and all liability—whether in contract, tort, or otherwise—for any damages, losses, injuries, or claims of any kind arising from or in connection with:

  • The accuracy, completeness, or reliability of information contained in user blogs
  • Any advice, tips, routes, or recommendations published by Users
  • Users or third parties acting upon or relying on user-generated blog content
  • Defamation, slander, hate speech, incitement, illegal content, or any other unlawful statements made by Users in their blogs
  • Personal injury, death, property damage, financial loss, or any other harm resulting from following or trusting user-published content

9.3 The Service is merely a technical platform for hosting and displaying user-generated travel blogs. We do not edit, curate, approve, or take responsibility for any User Content. All liability for user blogs lies exclusively with the respective author or User.

9.4 Mandatory statutory liability remains unaffected. All other liability—especially for user-generated content—is excluded to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold us, our affiliates, officers, directors, employees, and agents harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney’s fees) arising from:

  • Your user-generated content, especially your blogs and posts
  • Your violation of any third-party rights
  • Any person or entity’s use of or reliance on your published content
  • Your violation of these Terms of Service

This indemnification obligation will survive termination of your account and use of the Service.

11. Termination

11.1 You may terminate your account at any time.

11.2 We may suspend or terminate access without notice in the event of a material breach.

11.3 Upon termination, your right to use the Service ends immediately, and unused Credits are forfeited.

12. Final Provisions

12.1 We may amend this Agreement at any time. Material changes will be communicated within the Service. Continued use after changes take effect constitutes acceptance.

12.2 This Agreement is governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rights in your country of residence remain unaffected.

12.4 Severability

If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms and shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect. The parties agree to replace the invalid or unenforceable provision with a valid and enforceable provision that most closely approximates the intent and economic effect of the original provision.
